My "Journey Beyond the Three Seas" - An Indian Telecom Travelogue

I love Tver. My parents live in Tver. There are cute neighborhoods in town. Not very good roads, but where have you seen good roads in Russia? Especially refreshing is the crisp pine air in a little forest near Ordzhonikidze Street where we live. Tver is a typical quiet Russian provincial city. It is located a couple of hours by car from Moscow. Nowadays, its old churches and the bank of the Volga River are the only witnesses of Tver?s long and diverse history. What is interesting, though, is that Tver is connected to India.

No, Air India doesn?t fly to Tver and Aeroflot has not yet launched its first flight from the sleepy Tver airport to New Delhi. But back in the 15th century one simple Russian merchant, Afanasy Nikitin, ventured on a long trip from Tver to India passing the Black and Caspian Seas and crossing a number of countries to reach the western shores of that fascinating and exotic land. He masterfully described his life in India for three years (1471 to 1474). His travel notes ?Journey Beyond the Three Seas? became the first Russian report on actual life in old Indian kingdoms, a genuine account of everyday life thousands of miles away from Russia?

There are so many things that connect Russia and India. Nikitin?s travels in the 15th century were followed by Peter the Great?s mission in the 1700s. Then that ball went rolling all the way from philosophers like Tolstoy and Rerich to the first cosmonaut Yury Gagarin?s famous tour of India and a wildly popular Soviet movie, ?Moscow Does Not Believe in Tears,? in the 1970s. There was the saga called the USSR, long and interesting, starring Indira Gandhi, Lal Bahadur Shastri and Raj Kapoor, with festivals of Indian movies in Russia and the launch of a joint space crew. And then came 1991: the breaking year for a new Russia and also a powerful year for a new India.

Somehow and somewhere a strategic link between our two countries managed to come undone, and losing momentum we began wandering in our own universes. Building a new democracy didn?t come easily for either side. Almost two decades have passed since then, and now these two different countries are on the global scene, both quite confident and seeking greater prosperity for their people. Russia and India are now the part of a strong BRIC built in into the world economy. Today our outsourcing companies compete globally and make world-class partnerships; Lakshmi Mittal and Roman Abramovich share the Forbes? dining table; Indians take part in oil production projects in the Russian Far East and Russians are building power plants in India. Still, the level of bilateral trade is miniscule compared to the two countries? potential.

One area where cooperation must prevail is the high tech sector. Both Russia and India annually demonstrate outstanding growth in the ICT industry of 25%+, far beyond the US and EU.

Both Russian and Indian mobile sectors are bustling with a great vibrancy and deliver creative services. Indian companies have truly become the outsourcing yard of the world, and Russian IT businesses are learning fast. Broadband is sweeping Internet into its gigabyted pockets and 3G is zipping around the corner. Russian telecom holdings are knocking on India?s telecom doors announcing multi-million-dollar investments, but to no avail ? the key to the Indian Telecom Makhal is just not there! To understand better what?s happening in the sector, GidaByte and ComNews decided to launch an exploratory trip to India to find out the industry dynamics from the key Indian players. And there I went in early March 2007.

Well, unlike Nikitin?s adventures, my first travel to India didn?t last months, but quietly began in the Hong Kong airport, where I flew to New Delhi via AirIndia. In the plane I was seated with a very kind man who happened to be a member of the Jain religion. Amazingly, thanks to Mr. Jain, during our four hour flight I found out a lot about various cultural and religious aspects of Indian life. No need for Lonely Planet!

My story went on in a lovely bed & breakfast in a quiet New Delhi neighborhood. Constantly fed and entertained by a hospitable couple, I felt at home instantly and fell asleep some time after 2 a.m. The next three days were a constant eye-opener for me on Indian business and cultural life. I actually came to India to meet with the elite of the local telecom industry, but found out much more. On top of that, I got a bug. Don?t worry, it?s not infectious, it?s a bug of great interest in India.

Mr. T.V. Ramachandran?s office was my first stop. Mr. Ramachandran chairs the Cellular Operator Association of India, and has been in the telecom industry for quite a while. Proving his words that he truly enjoys what he does, Mr. Ramachandran quickly explained to me that GSM is the way to go, that India is ahead of China in terms of mobile growth and that the 3G era is around the corner, while voice will still be the killer application in the years to come. And I even was able to squeeze a secret from TVR (that?s how he likes to be called): ?Here is one more personal bet I am going to make, Andrey. This year we will see 8-9 million new mobile subscribers every month. That is going to happen, I think, and you know why? Because more operators are going to push into the rural areas due to the very innovative policy of the Indian Government to provide Universal Service Obligatory (USO) subsidy support for shared wireless infrastructure in rural areas.?

Beefed up by a great deal of information, I set my sails towards the leader of mobile world in India, Bharti Airtel. Meeting with Manoj Kohli, Bharti Airtel?s President, and Sanjay Kapoor, Airtel?s President of Mobile Services, provided me with a wealth of data on the thriving mobile industry in India. Traveling through the New Delhi?s thick morning crowd to the Gurgaon district, where Bharti?s headquartered, was a hassle, but it?s worth it to hire an Indian Schumacher! The guy simply flew through the swarms of tuk-tuks, cars, trucks, cows, policemen, you name it! I even managed to complete my morning newspaper by sticking it firmly under my left leg. What a day! But there you go, I reached Bharti Airtel?s offices.

Brightly lit with the morning sun, Kohli?s office radiated energy. Smiling and confident, it seemed Mr. Manoj Kohli shared with me no less than Bharti?s DNA. And I could feel it in him. This man believed in what his company was doing, which is always a key to success. The DNA is the entrepreneurial spirit instilled by the idea-man in charge, Sunil Mittal. Kohli says that ?from the Bharti company?s perspective, we are large, but in the global mobile perspective we are still small. And we?d like to maintain that spirit of a small company and we want to work just like a small company.? So what is Bharti doing with the tightening competition? ?Today competitors may copy virtually anyone?s move. The only thing that you cannot copy is our spirit. You cannot fake our passion. That?s why we win,? concluded Kohli with a smile.

At another neighboring Bharti building, Sanjay Kapoor, President of Mobile Services, opened his secrets of winning mobile customers via very innovative approaches, be it a famous ?Song Catcher? or a new platform for CPs that allow the company to deliver better content for more people. Yet behind all this lies Airtel?s people, or in Kapoor?s words: ?We take a lot of pride in our people. And people want to come and work for us. Right from zonal to operational levels, I think that the caliber of the people who work for us is great. And it is not about the money. People want to be associated with pioneering ideas. People are empowered.?

After this exposure to the world of the No. 1 Indian mobile operator, it was very important for me to learn more about the conductor of this mobile symphony ? Indian Telecom Regulator (TRAI). Soft spoken and very confident, TRAI?s Chairman Mr. Nripendra Misra reminded me of a true scholar who really knows his stuff. With impeccable logic and tons of examples, I was immersed in a quick course of telecom liberalization, 3G and DTH. It was short and sweet and on very short notice too. A nice touch of the past was that Mr Misra actually spent some time in my home town ? Tashkent, as a part of an Indian government delegation. We are all connected after all!

BSNL Managing Director, Mr. A.K. Sinha, met me in his office and gave me a comprehensive overview of what his state-backed company has accomplished during these years. Most impressive for me was the fact that it had become the No. 2 GSM operator, winning against strong competition from private mobile operators. This charismatic man was filled with energy and a willingness to compete with anyone, be it a private mobile operator or a foreign competitor. With a great pool of professionals BSNL was set to remain a leader for years to come, said Sinha. The changes in the telecom industry were striking, he said. ?Before people were standing in line to get a phone? I know because I?ve seen it ? people came to us and begged that they needed it, say, on medical grounds, etc. and now our people are begging them to buy a phone?so it is a reversal??

These changes were no more apparent than in Mumbai. Mumbai looked like the cradle of mankind; with its diverse crowds of people in business suits, turbans, homeless searching among the fresh leaves of green salad, Bentleys of the rich, and screeching and honking of taxis? What could possibly unite this city of extremes, thought I? And suddenly the answer came from the open window of a worn-out Volkswagen, where a local man was singing yet another popular Bollywood melody. Yes, Bollywood brings about that youthful and inspirational vibrancy, helping people dream and dream big! And the fresh proof of my thought was reflected in a cup of black aromatic coffee offered by Neeraj Roy, CEO of Hungama. Roy, a smart man in a crisp light blue shirt and sporting nicely cut grey hair, heads the mobile content and marketing company Hungama Mobile that holds the exclusive rights to Bollywood content. In just thirty minutes of our meeting in between constant calls of business partners and Bollywood stars, Neeraj confessed to me ? Bollywood is the killer-application in India ? and he is so right!

A helicopter descended at Reliance Communications, while we toured the company?s facilities, known as the Knowledge City. ?There?s Mr. Anil Ambani,?pointed out Mrinal Sapre, Corporate Communications Officer at Reliance Communications, while we were making our tour of the company?s facilities. ?Actually the territory of the Dhirubai Ambani Knowledge City is equal to that of the Vatican,?-- added Mrinal, smiling. When we entered Reliance?s control centre, it instantly reminded me of the Russian Space Flight Control Center in Korolyov. The facility had huge full scale monitors with a live record of the operator?s activities around India. Unbelievable! I stared and couldn?t finish my second coffee. I truly saw the future of the Indian mobile world, Reliance World.

Mr. Mahesh Prasad, Reliance Communications, President, Applications, Solutions & Content Group, told me that creativity and innovation were real differentiators for Reliance. But again the customer was the focus of its attention, actually two groups of customers. Prasad called them ?global Indians, or high end users, and aspiring Indians?. He went on to say that ?global Indians are like you and me, they probably have seen and used the best handsets and can afford the newest and the best. That?s what is happening in Japan, the US, Europe, etc. These high end customers are fully expecting that Reliance will offer the best of the best technology and services. And we provide that to them. Then in the group which I call the aspiring Indians, there are people who like services based on value. They are gradually improving their lifestyle, spending patterns, entertainment expenditures, etc.? With these two groups in mind and valuable offers in hand, Reliance is well set to compete and win.

Lawrence Kasdan To Pen Indiana Jones 4?

Lawrence Kasdan has been the prolific writer behind such films as Indiana Jones and Star Wars: The Empire Strikes Back and Return of the Jedi, but oddly enough, he has never worked with Harrison Ford.

Since the last installment of the Indiana Jones films - Indiana Jones and the last crusade - it has been 16 years that Lucas and Spielberg have been trying to come up with a good enough story line to continue the franchise.

Then why is it that Lawrence Kasdan who has so well-written these parts for Harrison Ford, is not put back in charge of putting the finishing touches to Indian Jones 4?

Frank Darabont who was brought in to pen out a umpteenth version of the script felt that he had done a solid job until George Lucas decided against it. You would think that the scribe who gave us Shawshank Redemption could write better material than Revenge of the Sith.

"This is what happens. Producers, often than not, get into these positions of power where they want to write-direct-edit and sometimes even act in their own projects," offered James Globins of free Hamburg entertainment.

Kasdan has had man box-office hits starting with the Big Chill, and followed by such films as The Accident Tourist, French Kiss.

"He hasn't had a hit since French Kiss. His last two films Mumford and Dreamcatcher were both very quiet and we're waiting to see what Risk Pool is going to do at the box-office."

What made the Indiana Jones series so great was the relationships between the characters and that's a key strength in any filmmaker. Relationships should always take front seat in any story and that's a mistake that many Hollywood films make. They overwhelm the audience with special effects and don't give them enough of what they went to the theatre for in the first place.

And please don't get me wrong, a film that concentrates and highlights the relationships between the characters doesn't have to fall into the "chick flick" category. 2005 has been a great year for those films that transcend categories and still prove that character and story are number one priorities. See Crash, Machiavelli Hangman, Sideways.

Indiana Jones 4 has to understand the dynamics of those great films and keep up with the present-day audiences. After so many years, Indiana Jones has to stretch or it'll fall flat on his face.

In a completely "stunning example", from doing back-office work for US and European firms, India has progressed to become a "centre for leading-edge innovation", prompting IBM to move all its business consulting design and development to India.

In a recent issue of Information Week, Paul McDougal writes about how IBM is gearing up to spend $200 million this year for the launching of its Indian centre, that will be responsible for handling the bulk of solutions development work for IBM worldwide, while its two existing development centres in India will play supporting roles. McDougal quotes Jeby Cherian, Head of IBM's new Global Solutions Delivery Centre in Bangalore, as saying: "Until this, we depended on any number of solution development centres across the globe. We're moving all of that development to India."

Cherian says, employees at IBM's new Indian centre will look to innovate and brainstorm as how best to combine IBM's vast array of hardware, software, and services products into pre-packaged offerings that their consultants can sell to specific industries. And, teams at the new centre will work on designing a system that will use telemetry devices, embedded processors and mathematical algorithms to help auto-makers better predict and manage warranty claim costs. As well, they will create systems that can work in so-called service-oriented architectures (SOAs), SOAs that feature reusable software components and applications that can be combined and re-combined in numerous ways. Currently, this work is being done at IBM's US and locations elsewhere in the world.

Confirming existing delivery centres outside India will not be closed, IBM says they will instead be "remapped" into demo centres, or as Cherian says: "They will become more customer-facing." Although, Information Week feels IBM's decision to off-shore virtually all its consulting offerings of design and development is sure to draw heat from critics, who believe American corporations should keep jobs, especially ones at this level in America, it has not deterred IBM's "hiring spree" in India, where it currently employs about 39,000 workers in the country, up from 23,000 a year ago.

Amitabh Ray, who runs IBM's global delivery operations in India, tells Information Week, the rate of growth will continue "for quite some time". If IBM's hiring spree in India continues as predicted, it will have more than 60,000 workers or about 20% of its worldwide workforce in India, by next year. While, it has 150,000 workers in USA, recent months have seen IBM quietly eliminating a number of domestic positions.

And, according to Ray, IBM's decision to shift its business solutions development to India will prove highly advantageous for the American company, but by extension its customers, as well. Not only will the move to India help lower costs, but greater centralisation will speed design and innovation. "In the previous model, these solutions were splintered across a number of development centres. We can get cross-visibility; something that's applicable in retail might be applicable in automotive." he went on to say.

IBM hopes its current initiative will give sales a badly needed boost, as the company's software revenues were rather flat in the last quarter, while service sales fell by five percent.

As India grows from strength to strength, the time has not come for it to rest on its laurels; instead the sub-continent should work on retaining its dominant edge.

"Whoever offers a leaf, flower, a fruit or even water with devotion, that I accept lovingly; offered as it is with a loving heart."

From time immemorial, Hindus have worshipped trees and have considered all flora and fauna as sacred. Trees, plants, leaves, flowers and fruit have an esteemed position in the religion and culture of India. So much so that no religious function especially Indian matrimonial is considered complete without the presence of at least one of the above. Leaves like the betel, banana, mango, Neem, tulsi, durva are intrinsically woven into the tapestry of Indian weddings.

The betel leaf enjoys the pride of place among all the accessories of a Hindu wedding. The betel leaf denotes freshness and prosperity. Betel leaves or the tambool, which comprises betel leaf, areca nut and lime, marks the beginnings of all auspicious events. In Indian matrimonial, alliances are sealed by exchanging the tambool. Invitations for an Indian marriage are distributed with tambool forming an important part of the invite. The betel is associated with the Trinity, Brahma, Vishnu and Shiva. Brahma: arecanut, Vishnu: betel leaf, and Shiva: lime.

The grooms' party is welcomed with betel leaves and every event in the wedding is solemnized with betel leaves. The tambool is the minimum and essential part of hospitality in every Indian wedding.

In some weddings, a betel leaf is tucked into the headgear of the bride and groom.

In certain regions the groom's mother or sister gives a ceremonial welcome to the bride. Seven cups are placed on a platter along with fruits, betel leaves, rice, sacred ash, turmeric, salt, tamarind and cotton. A measuring cup is filled with paddy and a betel leaf is placed on it. This is called the 'nirai nazhi'. Water is placed in a vessel and the bride stands facing the east. The person performing the ceremony touches the seven cups three times and puts sacred ash on herself and on the bride. After this is done twenty one times, the bride is given a betel leaf and water is poured on it. The person conducting the ceremony touches the leaf to her forehead giving her a ceremonial welcome.

In yet another ritual comprising the betel, the girl's brother gives the ceremonial first betel to the couple to chew . This ritual is the thaamboola charvanam.

Betel leaves along with coconut or fruit are given as a token of thanks to every guest attending the wedding.

The meaning of the claims in issue must be determined by a study of all relevant patent documents. The relevant patent documents include the intrinsic evidence of claim language, specification and prosecution history.

Claim Language: It is that language that the patentee chose to use to make a distinct claim over the subject matter of the invention. A claim is never a specification embodiment, but a separate body which extends the scope of protection. The ordinary language of the claims can be attributed to that of a person skilled in relevant art. Hence a claim language must disclose a single and clear definition of claim scope,

Specification: It is ideal for the presiding officers to interpret the claims to consult the specifications and prosecution history to understand the meaning of the terms to one of skill in the art at the time of invention. The proper examination of the claims, the specification, and the prosecution history would serve as the tools for the proper interpretation of the claims.

Specification as such can be best treated as a dictionary as it provides the explicit and implicit meanings of claim terms and it is the best guide to the meaning of a disputed term. From popular cases like Grain Processing Corp. v. American Maize-Products Co. and Teledyne McCormick Selph v. U. S., it is evidently clear that patent claims are to be construed in the light of the specifications and both are to be read with a view to ascertaining the invention. The patent specifications must be looked to in the interpretive process of ascertaining the scope of the claimed invention. (U.S.--Interdent Corp. v. U. S.(1976)),

Prosecution History: Prosecution history can provide clarification regarding the patentee's understanding of the invention and can be of primary significance in construing the scope and meaning of claim terms. The prior art contains express definitions of claim terms that are considered highly pertinent during prosecution, these definitions may override the ordinary meaning of claim language.

Apart from above some external factors such as all evidence external to the patent and prosecution history, including expert and inventor testimony, dictionaries, and leaned treatises. This evidence may be helpful to explain scientific principles, the meaning of technical terms, and terms of art that appear in the patent and prosecution history. In case the dependence on the evidences like claim language, specification, prosecution history fails to tell the meaning it would be ideal to go for the external evidences like expert testimony, inventor testimony, prior art mentioned in the records, publication and speeches to provide the meaning. The other external evidences like admissions in discovery responses, internal documents and scientific publications. Technical treatises and dictionaries can not be categorized as patent documents but for better understanding they used to be consulted. Still their significance is not enough to override the evidences like claim language, specification and prosecution history to interpret a claim. So far as patent specification acts as a dictionary it defines terms used in the claims and as stated above the specification is the best guide to the meaning of a disputed term.

A clear message is conveyed to the inventors to make their claim more unambiguous, plain speaking, meant to protect the scope of their invention at any cost. Hence precautions have to be taken by them while they write specifications and claims. They have to be aware of the principles taken into account while construing the claim language which otherwise may damage the chances for a prospective patent.

Anti-Genetic Engineering Activism in India Targets Bt Brinjal

Maharashtra Hybrid Seed Company (Mahyco) sought the permission of the Genetic Engineering Approval Committee (GEAC) of India, for large-scale open field trials of eight Bt brinjal hybrids. This threw the anti-tech activists in India into a tizzy. ?Position papers on Bt brinjal?, spiced with a lot of pseudo-science have been widely circulated, demanding GEAC?s ban of all transgenics in India. The GEAC placed the biosecurity data provided by Mahyco on their website for public comment. The propaganda machinery has now drafted, anti-GE experts/scientists from the US, UK and New Zealand.

Brinjal (aubergine, egg plant, Solanum melongena) is a vegetable in Asia and Europe. The original Persian/Arabic name al-bAdhinjAn, gave rise to, a) with the al, the French name 'aubergine' derived from Catalan alberg?nia, and b) without the al, the Portuguese berinjela, and the Spanish berenjena, which became brinjal in Indian and Sri Lankan English. The samskrith name vatinganah, produced baingan in Hindi, van(g)kayi in Telugu (-kayi is raw fruit), badanekaryi in Kannada and similar names in Indian languages.

Centres of Origin of cultivated plants are determined on a variety of circumstantial evidence, especially on the number and diversity of related wild species. In most cases there is hardly any sound scientific proof for the conclusions drawn.

Overall evidence strongly suggests that South America was the Centre of Origin of the species of the genus Solanum, to which both potato (Solanum tuberosum) and brinjal belong.

The exact origin of Solanum melongena is uncertain. It probably originated from the African wild species Solanum incanum. Solanum melongena was first domesticated in Southeast China, and taken to the Mediterranean region during the Arab conquests in the 7th century. If brinjal was mentioned in ancient Indian literature, it only indicates that it was naturalized, having been introduced into India, a long time ago and this in itself is not an evidence of its origin in India.

Centres of Diversity are determined on the basis of the number and diversity of related species or varieties in the wild. The fundamental criterion of relationship is that two or more species or varieties freely interbreed producing fertile offspring. The number and diversity of cultivated varieties of a crop species in a country is not the basis to determine origin and diversity, as developing such varieties is an essentially human activity.

A decade or so ago, considerations of origin and diversity were of some significance in crop plant breeding, to aid the choice of species/varieties with desirable genes and to produce fertile hybrids with the cultivated varieties of the related crops. With several techniques of molecular biology and genetic engineering available now, the relevance of theoretical and academic inferences on the Centres of Origin and Diversity has diminished considerably.

Several species of Solanum occur in the wild in India. Cytogeneticists have artificially produced interspecific hybrids of species of Solanum. It was not so difficult to produce first generation hybrids, which generally suffered from chromosomal instability and pollen sterility, hardly resulting in any fertile hybrids.

Random Amplification of Polymorphic DNA analysis (RAPD, a technique in genome comparisons) shows that Solanum incanum and then Solanum viarum are the closest to Solanum melongena. Solanum incanum and Solanum viarum occur infrequently in the wild in India, but are hardly sympatric and panmictic with the cultivated varieties. When artificial hybrids were produced, the progeny were sterile, leaving no chances for gene flow among these related species.

In nature, species of Solanum do not normally hybridize, as they are predominantly (over 90 per cent) self-pollinated. Anthers that open by small apical pores are the characteristic feature of the genus Solanum, unlike in many other plant species where the anthers open dehiscing longitudinally to fully expose the pollen to the air and pollinators. Solanum pollen are sticky and do not travel long distances, even if they become airborne. Insects visit Solanum flowers but their role in pollination is insignificant.

There are many cultivated varieties of brinjal in India, some of which are restricted to specific regions, as for example the ?Udupi gulla? variety of Mangalore. Wild species of Solanum and several cultivated varieties of brinjals co-exist. However, farmers and scientists are not aware of any hybrids between the two groups and no effort is made to protect different varieties of cultivated brinjals from hybridizing among themselves or with the wild Solanums.

The floral structure and the reproductive biology of brinjals and experience in cultivating them for several centuries in India, do not suggest any possibility of gene flow from transgenic brinjals to normal brinjals.

The biosecurity of Bt insecticidal proteins in transgenic crops is thoroughly assured by evidence on the use of Bt pesticides for over 60 years and the cultivation and consumption of Bt transgenics for a decade. None of the extensive studies on the safety of Bt proteins conducted in various countries has indicated any possibility of their being harmful to animals and humans or the environment.

Cry 1 Ac is toxic only under specific conditions. It is non-toxic to all organisms with an acidic stomach and with no binding sites for the crystal protein, which includes all mammals and non-target organisms.
Brinjal fruits are not toxic to mammals. But, all the other parts of the brinjal palnt are toxic, due to several alkaloids. Cattle are not deliberately fed on brinjal plants. Grown under water scarcity, even the fruit accumulates alkaloids and phenolic compounds, which give a bitter taste and make the fruit inedible.
Scientific evidence does not indicate any possibility of Bt brinjals posing serious or unmanageable risks to the farmers, consumers or the environment.

Basics Of Patent Law In India

History

In 1957, Govt. of India appointed Justice N. Rajagopala Ayyangar examine and review the Patent law in India who submitted his report September 1959 recommending the retention of Patent System despite shortcomings. The Patent Bill, 1965 based mainly on his recommendations incorporating a few changes, in particular relating to Patents for food, drug, medicines, was introduced in the lower house of Parliament on 21st September, 1965. The bill was passed by the Parliament and the Patents Act 1970 came into force on 20th April 1972 along with Patent Rules 1972. This law was suited changed political situation and economic needs for providing impetus technological development by promoting inventive activities in the country.

Uruguay round of GATT negotiations paved the way for WTO. Therefore India was put under the contractual obligation to amend its patents act in compliance with the provisions of TRIPS. India had to meet the first set of requirements on 1- 1-1995. This was to give a pipeline protection till the country starts giving product patent. It came to force on 26th March 1999 retrospective from 1-1-1995. It lays down the provisions for filing of application for product patent in the field of drugs or medicines with effect from 01.01.1995 and grant of Exclusive Marketing Rights on those products.

India amended its Patents Act again in 2002 to meet with the second set of obligations (Term of Patent etc.), which had to be effected from 1-1-2000. This amendment, which provides for 20 years term for the patent, Reversal of burden of proof etc. came into force on 20th May, 2003. The Third Amendment of the Patents Act 1970, by way of the Patents (Amendment) Ordinance 2004 came into force on 1st January, 2005 incorporating the provisions for granting product patent in all fields of Technology including chemicals, food, drugs & agrochemicals and this Ordinance is replaced by the Patents (Amendment) Act 2005 which is in force now having effect from 1-1-2005 .

ESTABLISHMENT OF PATENT ADMINISTRATION IN INDIA

Patent system in India is administered under the superintendence of the Controller General of Patents, Designs, Trademarks and Geographical Indications.

The Office of the Controller General functions under the Department of Industrial Policy and Promotion, Ministry of Commerce and Industry. There are four patent offices in India. The Head Office is located at Kolkata and other Patent Offices are located at Delhi, Mumbai and Chennai. The Controller General delegates his powers to Sr. Joint Controller, Joint Controllers, Deputy Controllers and Assistant Controllers. Examiners of patents in each office discharge their duties according to the direction of the Controllers.

Patentable Inventions:

A patent can be granted for an invention which may be related to any process or product. The word ?Invention ? has been defined under the Patents Act 1970 as amended from time to time.

?An invention means a new product or process involving an inventive step and capable of industrial application? (S. 2(1)(j))

? new invention? is defined as any invention or technology which has not been anticipated by publication in any document or used in the country or elsewhere in the world before the date of filing of patent application with complete specification, i.e. the subject matter has not fallen in public domain or that it does not form part of the state of the art; Where, Capable of industrial application, in relation to an invention, means that the invention is capable of being made or used in an industry

(S.2 (1)(ac)) Therefore, the criteria for an invention to be patentable are,

(1) An invention must be novel

(2) has an inventive step and

(3) is capable of industrial application

To be patentable, an invention should fall within the scope of patentable subject matter as defined by the patent statute. The invention must relate to a machine, article or substance produced by manufacture, or the process of manufacture of an article. A patent may also be obtained for an improvement of an article or of a process of manufacture. With regard to medicine or drug and certain classes of chemicals no patent is granted for the product itself even if new, only the process of manufacturing the substance is patentable. However, product patents would be available for drugs and food materials from 2005 as India?s obligations under the TRIPs Agreement would kick in from that point of time. If any substance falls outside the scope of patentable subject matter, it cannot be patentable.

NOT PATENTABLE INVENTIONS

There are some products and processes, which are not patentable in India They are classified into two categories in the patent act

a) Those which are not inventions (S.3)

b) Invention relating to atomic Energy (S.4)

Various types of non-patentable inventions under Section 3 are as follows-
3(a) An invention which is frivolous or which claims anything obvious contrary to well established natural laws.

Merely making in one piece, articles, previously made in two or more pieces is frivolous. Mere usefulness is not sufficient (Indian vacuum brake co. ltd vs. Laurd (AUR 1962 CAK 152).

Perpetual motion machine alleged to be giving output without any input is not patentable as it is contrary to natural law.

3(b) An invention the primary or intended use or commercial exploitation of which could be contrary to public order or morality or which causes serious prejudice to human, animal or plant life or health or to the environment

3(c) The mere discovery of a scientific principle or the formulation of an abstract theory or discovery of any living thing or non-living substances occurring in nature;

3(d) The mere discovery of a new form of a known substance which does not result in the enhancement of the known efficacy of that substance or the mere discovery of any new property or new use for a known substance or of the mere use of a known process, machine or apparatus unless such known process results in a new product or employs at least one new reactant.

Explanation- For the purposes of this clause, salts, esters, ethers, polymorphs, metabolites, pure form, particle size, isomers, mixtures of isomers, complexes, combinations and other derivatives of known substance shall be considered to be the same substance, unless they differ significantly in properties with regard to efficacy.

[Note: Before amendment of Section 3 (d) by the Patents (Amendments) Ordinance 2004 it reads as ?mere discovery of any new property or new use for a known substance or mere use of a known process, machine or apparatus??The insertion of the word ?mere? before ?new use for a known substance? in this clause by the Patents (Amendment) Ordinance 2004, is for the purpose of drafting clarity only as without it the sub-section would have remained ambiguous. This does not restrict the nonpatentability and give rise to ambiguity and possible misuse. There is no
need of giving wider meaning to it.]

3(e) A substance obtained by a mere admixture resulting only in the aggregation of
the properties of the components thereof or a process for producing such substance:

3(f) The mere arrangement or re-arrangement or duplication of known devices each
functioning independently of one another in a known way.

3(h) A method of agriculture or horticulture.
(i) A method of producing a new form of a known plant even if it involved a modification of the conditions under which natural phenomena would pursue their inevitable course is not patentable. (N.V. Philips Gloeiammpenfabrieken's Application 71 RFC 192).

3(i) Any process for the medicinal, surgical, curative, prophylactic diagnostic therapeutic or other treatment of human being or any process for a similar treatment of animals to render them free of disease or to increase their economic value or that of their products.

Plants and animals in whole or any part thereof other than microorganisms but including seeds, varieties and species and essentially biological processes for production or propagation of plants and animals;
Example: Clones and new variety of plants are not patentable. But process / method of preparing Genetically Modified Organisms are patentable subject matter.

3(m) A mere scheme or rule or method of performing mental act or method of playing game;

3(n) A presentation of information

3(o) Topography of integrated circuits;

INVENTIONS RELATING TO ATOMIC ENERGY (S.4)

Procedural requirements

An application for a patent in the prescribed form along with the prescribed fee has to be filed in the appropriate patent office. Examiners of patents scrutinize the application accompanied by a specification so that it satisfies the requirements. After examination, the Patent Office will raise objections and once the applicant convinces the Controller Of Patents will put the specification in the Official Gazette and on its acceptance without any controversy, a patent shall be granted.

A patent grant gives the patentee the exclusive right to make or use the patented article or use the patented process by preventing all others from making or using the patented article or using the patented process. The patentee can assign, grant licenses or deal for consideration.

The patent application passes through the following stages:

FILING

An application for a patent can be filed by the true and first inventor. It can also be filed the by the assignee or legal representative of the inventor. If an application is filed by the assignee, proof of assignment has to be submitted along with the application. The applicant can be national of any country.

Form of Application

Every application shall be accompanied by a provisional or complete specification. Provisional applications are generally filed at a stage where some experimentation is required to perfect the invention.

Filing of a provisional specification allows the applicant to get an early application date.

Provisional Specification shall contain:

a. Title,

b. Written Description,

c. Drawings, if necessary and

d. Sample or model if required.

The complete specification shall contain:

a. Title,

b. Abstract,

c. Written Description,

d. Drawings (where necessary),

e. Sample or Model (if required by the examiner),

f. Enablement and BestMode,

g. Claims and

h. Deposit (Microorganisms)

Priority Date

Priority date is the date of first filing allotted by the patent office to an application. If a provisional application is followed by a complete application, the priority date shall be date of filing of the provisional application. If an Indian application is filed after a foreign or PCT application, the priority date shall be the date of filing of the foreign or PCT application. If an application is divided into two applications, the priority date shall be date of filing of the parent application.

Priority date is the date of reference used by the patent to determine the newness of the invention. If the claimed invention is part of public knowledge before the priority date, it will not be eligible for a patent. Under US Law, priority date is pushed back to the date of conception for determining novelty and Non-obviousness.

Place of Filing

Patent Application can be filed at any of the four patent offices in India. Patent Offices are located at Kolkata, New Delhi, Chennai and Mumbai.

Form 1 - Application for the grant of patent.

Form 2 - Provisional or Complete Specification.

Form 3 - Statement and undertaking by the applicant.

Priority document details have to be filed for a Convention application.

PUBLICATION

A patent application will be published on expiry of eighteen months after the priority date. It can be published earlier, if such a request is made by the applicant. The application will not be published if directions are given for secrecy, until the term of those directions expires. It will also not be published if the application is withdrawn three months before publication date.

On publication, specification including drawings and deposits shall be open for public inspection. The rights of the patentee start from the date of publication but they cannot be enforced until after patent grant.

EXAMINATION

1. Request for Examination

The process of examination starts with a request for examination. The request has to be made within 36 months from the date of priority or filing. However, if secrecy directions have been given for the application, the request can be made six months after the directions are revoked or thirty six months from the date of priority or filing, if that date is later.

2. Examination

On receiving the request, the controller shall direct the patent application to the Examiner for examination. To start with, the examiner makes a formal examination by verifying the propriety and correctness of all documents filed with the application. Later, he verifies the patentability of the application. The patentability analysis includes all patentability requirements.

After confirming that the application falls within the scope of patentable subject matter, the examiner conducts a prior art search to check if there is prior art, which anticipates the invention claimed. Prior art search for anticipation includes search for anticipation by publication, filing of complete specification, etc. He then verifies the existence of inventive step, Industrial application, and Enablement and Best mode.

The examiner will give the examination report within 1 month from the date of reference by controller and that term shall not exceed three months. If the examination report is adverse, the controller sends a notice to the applicant and gives him an opportunity to correct and if necessary an opportunity of hearing. The Controller might ask the applicant to amend the application in order to proceed further. If the applicant does not make such changes, the application might be rejected.

The Controller has the power to divide the application, post date the application, substitute applicants and reject the application. An order of division will be given if the application contains more than one invention and if it is required to file separate applications for each invention. The application might be post dated to a period of six months if requested by the applicant. Substitution of inventors is generally done if the inventor has been wrongfully mentioned or if a joint inventor has not been mentioned in the application.

The controller has the power to reject the application, if the applicant does not comply with his requirements.

OPPOSITION

1. Pre-grant Opposition

Any person can file an opposition for grant of patent after the application has been published. Opposition may be filed on any of the following grounds:
a. Non compliance of patentability requirements.
b. Nondisclosure or Wrongful disclosure of genetic resources or traditional knowledge.

2. Post-grant Opposition

Any person can file an opposition within a period twelve months after the grant of a patent. It can be filed based on the following grounds:

a. Wrongful obtainment of the invention by the inventor.

b. Publication of the claimed invention before the priority date.

c. Sale or Import of the invention before the priority date.

d. Public use or display of the invention.

e. The invention doesn?t satisfy the patentability requirements.

f. Disclosure of false information to patent office.

g. Application for the invention is not filed within twelve months from the date of convention application.

h. Nondisclosure or wrongful disclosure of the biological source.

i. Invention is anticipated by traditional knowledge.

3. Process of Opposition

On receiving a notice of opposition, the controller notifies the patentee. He then constitutes an Opposition board to deal with the opposition. The Opposition board decides the issues after giving reasonable opportunity of hearing to both the parties. The Opposition board might invalidate the patent, require amendments or maintain the status quo. If amendments are required, they have to be made within the prescribed period in order to maintain the patent.

E. GRANT

If the application satisfies all the requirements of the patent act, the application is said to be in order for grant. An application in order for grant shall be granted expeditiously. A granted patent shall be published in the official gazette and shall be open for public inspection. Every granted patent shall be given the filing date. The patent will be valid throughout India. A granted patent gives the patent holder the exclusive right to make, use, sell, offer for sale and import the product or use the process. However, the government can make use of the patent for its own purposes or for distributing an invention relating to medicine to hospitals and dispensaries. Furthermore, any person can make use of the patent for experiment or education.

Assignments

A patentee may assign the whole or any part of the patent rights to the whole of India or any part thereof. There are three kinds of assignments: legal assignment, equitable assignment and mortgages. An assignment of an existing patent is a legal assignment where the assignee may enter his name as the patent owner. A certain share given to another person is called an equitable assignment and a mortgage is when patent rights are wholly or partly transferred to obtain money.

Licenses

A patentee may, by a license, permit others to make, use, or exercise, the invention which otherwise would not be allowed. The license should be in writing and the terms of which must be given in the application filed with the Controller. A license maybe given in express terms or implied from the circumstances. An exclusive license excludes all other persons including the patentee from the use of invention In a limited license the limitation may arise as to persons, time, place, manufacture, use or sale.

Compulsory Licenses and Government use of inventions

Under certain circumstances like when reasonable requirements are not satisfied, a very high royalty is quoted, when a patent cannot work without another related patent or on notification by the Central government, the Controller can grant a license to an interested person.

The Central or State government can use for a purpose of its own all patented inventions or processes either with or without royalty.

Revocation of a patent

A patent may be revoked by various modes namely revocation in the public interest by the Government or relating to atomic energy by Controller. A patent may also be revoked for non-working. The High Court may revoke a patent on noncompliance with the requirements for use of an invention or on petition by a person interested on various specified grounds.

A patentee may at any time offer to surrender his patent by giving notice to the Controller, whom after hearing the parties may revoke the patent.

Patent enforcement and Infringement of patents

Infringement of a patent is the violation of the exclusive rights of the patentee.
Determination of infringement depends on the scope of exclusive rights of the patentee, whether the infringer?s acts amount to making, using, selling or distributing a product or using a method and if in fact the acts amount to an infringement. The burden of proof is on the patent owner for proving infringement.

Defenses

The defendant in a suit for infringement may plead one or more defenses. He can claim the patent owner is not entitled to sue for infringement or deny any infringement. Any leave or license express or implied to use the invention does not amount to infringement and where infringement is invalid on certain grounds.
Acts done in connection with government use, experiment, research, education and falling within the scope of innocent infringement or done after failure to pay renewal fee or before the date of amendment of the specification do not amount to infringement. A defendant may also counter claim for revocation of patent.

Remedies

Injunctions act as a preventive relief to the patentees. The patent owner at the start of a trial can request for an interim injunction in order to restrain the infringer from continuing the infringement to prevent further losses. Permanent injunction is given based on the merits of the case at the end of the trial. A patent owner is entitled to the relief of damages as compensation to the patentee and not punishment to the infringer. The patent owner may also opt for the account of profits where he has to prove use of invention and the amount of profit derived from such illegal use.

INTRODUCTION

The philosophy of education is to acquire right knowledge of different aspects and dimensions of the world around us and to disseminate the same for the benefit of the individual, society, nation and world.

The present day?s education, though has undergone a radical change, with the development of modern science and technology, especially the computers, much needs to be done on the holistic approach to education, which can evolve personality. One might get tremendous amounts of information by logging on to the Internet, and the glut of information will lead to information garbage. In spite of all these we are lagging in imparting right education to right people thereby, creating disharmony. Therefore, one needs to have proper guidance and an evolved system which will lead to evolution of personality. This system should have a positive impact on the thinking process, beliefs, attitudes with its holistic approach to concepts, methods and techniques; thus creating harmony and ushering in peace.

Today, in majority of the cases, mathematics is considered to be a dry subject and still notion exists that it is only for the intelligent. Many dread mathematics, because the teachers themselves teach in an unimpressive way and the joy of making learning of mathematics a pleasurable experience is almost lacking. This is found right from the school to the college level.

In this regard, Vedic/Ancient Indian Mathematics (VM/AIM) with its wonderful concepts, methods and techniques, which have stood the test of time comes in handy for imparting a holistic, creative education in mathematics.

The Vedic Seers and Ancient Indian Scientists and Mathematicians perceived mathematics in Nature, in the form of primordial concepts, the different shapes and patterns symbolising the cosmic truths in the Micro and Macro aspects.

Mathematics was developed right from the fundamental concepts of Numerals, Place value, Zero and Infinity to the advanced concepts finding their applications in the Artificial Intelligence, computer based numerical methods, philosophy, science, arts, etc. In fact, one will be baffled by the fertile imagination of the ancient seers and scholars, who perceived mathematics in nature in all its glory and expressed the great mathematical truths and concepts through hymns, theorems and postulates which are lyrically beautiful, yet mathematically precise which speak volumes about them. It goes without saying that these methods, concepts and techniques of Mathematics in the form of Slokas and Sutras (Aphorisms) were conceived by the Ancient Indian Seers and scholars, centuries before their modern counterparts.

OBJECTIVE

(a) The present objective is to create an awareness about the vast potential of the Vedic/Ancient Indian Mathematics (V.M./A.I.M.) for the curriculum development and R & D works.

(b) To demonstrate with practical examples chosen from different levels of mathematics education; the benefits of learning V.M./A.I.N. like faster computing time, alternative and creative approach to problem solving, etc. This is substantiated by the results of number of workshops and case studies conducted.

(c) To motivate scientists scholars, teachers, philosophers and others to take up an in-depth study of VM/AIM in proper perspective and adopt it to the modern times, so that a great amount of this wonderful traditional knowledge is revived and developed which would be a true homage to the Seers and Scientists of yore.

(d) Last but not the least, to pave way for the adoption of time tested VM/AIM in the school/college curriculum and establish dedicated RBD centres.

APPROACH

An Integrated approach for the study and learning VM/AIM is made:

(i) Mathematical concepts embodied in the Vedas, Upanishads.

(ii) ?Vedic Mathematics? as expounded by H. H. Bharatikrishna Teerthaji consisting of 16 Aphorisms and 16 Corollaries, covering different topics in Mathematics, right from the fundamental Arithmetic operations to the higher level of Mathematics.

(iii) Ancient Indian Mathematics ? contribution by various mathematicians of yore up to the celebrated genius Ramanuja. This integrated approach is unique of its kind. Various methods techniques are culled out, analysed and are expressed in modern mathematical notations, making it easily adaptable.

SELECTION CRITERIA

The methods and techniques are selected based on the following criteria. If the VM/AIM methods are better than the conventional ones in terms of step size, length, computation time, elegance and novelty, either individually or collectively, then these are selected in place of the conventional ones.

TECHNIQUE

The teaching of VM/AIM is done following the usual techniques like lecturing, using Audio-visual equipments like OHP, slide projector, computer aided learning, etc.

Before we go into the subject of VM/AIM in terms of examples, it is imperative to know at least some fundamental facts about the Vedas, their nature, structure, etc., which would facilitate in understanding and appreciating the mathematical concepts embodied in the Vedas.

Vedas are the earliest systematic literature in the entire world existing since thousands of years, which have stood the test of time and continue to challenge the mankind with renewed freshness and vitality. Vedas, which are the fountain head of knowledge and wisdom, are built upon sound structure which are definite, clear, unambiguous, generative and complete, thus satisfying the properties of an algorithm! This amply proves the fact that the Vedas are the highest revelations to the Rsis (Seers) of Yore and are not a mere compendium and collection of literature from different parts of the world, and no second version of Vedas exists anywhere. Hence, the Vedas have to be studied and analysed in proper perspective, in order to bring out the truths hidden in them. Now let us take some stock illustrations from Vedas and other ancient Indian sources in Mathematics at different levels i.e. right from the fundamental level of Arithmetic to Algebra, Calculus, Quadratics, Polynomials, Astronomy, Geometry, etc. which will give a glimpse of the vast scope of the same.

Now coming to the Vedas, the most outstanding, fundamental contribution for which the entire world is beholden to ancient India is the invention of decimal numerals (with place values), zero and infinity, for example: 576, 685, 1998, etc. Can there be a more elegant, better method where the digits placed in the units, tenths, hundredths or thousandth place, indicate their respective values and magnitude.

In arithmetic operations one finds use of complimentary numbers very effectively and finds 10 different varieties of multiplication based on the Vedic mathematical Sutras propounded by H. H. Bharatikrishna Teertha (1880-1964). He being a brilliant scholar and Saint discovered 16 aphorisms and 16 corollaries after 8 years of intense penance, covering variegated topics (both elementary and advanced) in mathematics. Consider the following examples:

(i) Complimentary numbers Here the objective is to convert all the numerals greater than 5 to less than 5 in order to facilitate speedy calculation and reduce carry over. For ex. 9,8,7,6 are expressed as 1,2,3 & 4 respectively with base as 10.

(ii) Using complimentary notation known as ?Vinculum? following examples will make clear, about the usage and benefits of this:

(a) 28 -> 32 [eq. to 30-2]

(b) 19 -> 21 [eq. to 20-1]

(d) 289621 -> 310421

Note: whenever complimentary notations are used, the digit preceding, gets augmented by 1 and while normalising it gets reduced by 1. In the example (d) we see how only the digits greater than 5 are converted and the others remain as they are.

Before we take up other topics in Mathematics we cannot help but quote some examples on the philosophical aspect of numbers, which the ancient seers very effectively utilised.

Now let us consider this very interesting example. The idea of counting nine numbers and zero which is an Indian system is closely connected with nine months of development of human embryo. Man develops in nine months through nine successive stages, like the nine number and completes his birth in the 10th and this is the 10th Avatara of ?MAN? to put it figuratively. Similarly the body has nine openings (Navadvara) and the 10th being the Brahmadvara which can be located in the soft region in the head in a new born infant. This small micro-opening called the Brahmarandhra. At the top of the head through which a yogi leaves the body. Thus the 10th opening is the gate to the highest stage of development, similar to his birth from the womb in the 10th month. In the former he is delivered downwards and in the lateral upwards! This is the essence of story of deliverance of man from the imprisoning restrictions of matter which has been beautifully delineated in many philosophical Tantric and musical texts.

Similarly the concept of Sets and cardinal numbers are conceived by the Seers and scholars. For example we have deep significance for numbers like seven as Saptaswara (seven basic notes in Music), Sapta Rsis (seven great sages), Saptavarna (seven colours), nine planets (Navagrahas), Navanidhi (nine treasures), Dasadik (ten directions), Ekadasa Rudra (eleven Rudras), Dvadasamasa (twelve months), Saptavimsat Nakshatrah (27 stars) etc.

Similarly we can quote many examples from different branches of mathematics, even in geometry: the Sulva Sutras (which are the origin of geometry) make use of this branch of mathematics to construct varieties of altars for the purposes of sacrifices. The magnificent temples which stand testimony to the skills and designs of the workers are the living examples of applied mathematics.

Mathematics was also brought into worship by use of Mantrabandhas which are nothing but mystical geometric diagrams inscribed with digits or cosmic energy capsules (beejaksharas). These diagrams are of various sizes, shapes and colours. The word of Mantra and Tantra is indeed a network of energies, forces and vectors and are very dynamic. These geometric forms indicate outward manifestation of the spirit so as to exert its influence in the desired manner. The power possessed by the Yantra (graphical representation) is sought to be stepped up by their inscription and infusion of the appropriate Mantra. In short these can be termed in the modern context as the printed circuit boards which vibrate into light through the electrical energy passed and performs the desired functions independently and collectively. The Yantra is the basic hardware and the Mantra is the software.

CONCLUSIONS

1. Vedic/Ancient Indian Mathematics (VM/AIM) with their novel methods, techniques and approach help the learners to develop their aptitude and creative rational thinking.

2. The VM/AIM which have stood the test of time for centuries with their novel creative approach and techniques help the students to develop their intuitive capacity, which in turn has a positive impact on the right half of the brain, paving way for the holistic development.

3. Many workshops and courses conducted for students of different classes, be it urban or rural, have proved the efficacy of these and the results are very encouraging.

4. It has been found from practical trials that one year portion of school curriculum in mathematics can be completed in about 60% of the time, thus making learning faster and enjoyable. In fact VM/AIM has been popularly known as ?Maths with Smiles?.

5. This will prove to be a boon for all the competitive exams, with its much faster and accurate results and can be adopted globally.

6. Learning of VM/AIM leads to education in different dimensions and appreciate philosophy, religion in better perspective which in turn has a positive impact on the personality development, leading to harmony and peace.

7. VM/AIM open up new vistas for R&D, especially on computer based numerical methods, development of new algorithms apart from opening up of frontier areas of interdisciplinary research. Example: Nyayasastra (one of the six Darshanas has wonderful scope in Artificial Intelligence). The author has already culled out and developed about 15 computer based numerical methods based on VM/AIM which are unique of their kind.

8. The Ancient Indian Mathematics not only kept up the curriculum development, but also made mathematics interesting to house wives, common people and people from non-mathematical areas of study. They composed aphorisms, slokas and hymns, which were lyrically beautiful yet mathematically precise, thus contributing to the holistic development of the subject.

9. Last but not the least, study and practice of VM/AIM with their creative and novel approach can aid in holistic development of personality. This will not only revive the ancient treasure of knowledge and wisdom, but also will be a true homage to the great Seers and Scholars of Yore.

China And India - Two Of A Whole

The Chinese name for China is Zhongguo, meaning Middle Country. In China, people often ask me why Zhongguo is called China by the laowai (foreigners). I explain to them how every culture or language has different names for other countries. For instance, the Chinese name for India is 'Yindu' - close enough but not the same; USA is called Meiguo, a little dissimilar and so on. A knowing smile then lights up their faces.

There are many similarities betwen India and China. When my short-stories were first published in China in a magazine and later in a book, my readers and editor, in particular, marvelled at how a 'foreigner' could understand China and the Chinese so well. I believe that happened because I, in the true Hindu spirit, was willing to accept and not judge. That apart, I think, there are many similarities between the two ancient neighbours.

China has a history as old as India's - or thereabouts, anyway. For thousands of years we have shared a long common boundary and perfected the art of peaceful co-existence, except for that one incident in 1962. That apart, there has never been any violence between the people of the two countries. Yes, there were invasions from the north or northwest by Mongols. But, Mongols were different from the predominantly Han Chinese and came from further north of China. The Chinese never invaded India and Indians never invaded China. Yet, for most of the twentieth century we had the Asian equivalent of the US-USSR Cold War. Thank you, politics!

At a philosophical level, Hinduism and Taoism are quite similar. Like Hinduism, Taoism believes in the essential oneness of all creation and focuses on meditation as the way to achieve that realization. Confucianism, a later religion, however, is more orientated towards the material reality and teaches one how to best conduct oneself in society. Buddhism, however, was taken from India by the Chinese who came and studied the religion and then carried with them important scriptures, books and literature on the religion. India or its rulers did not need to send missionaries and crusaders into China to spread Buddhism.

The Chinese were probably the most inventive amongst all the ancient cultures and a huge number of inventions like paper, printing, compass, gunpowder, the wheelbarrow, clock and so on are believed to have been Chinese in origin.

Interestingly, there was one dissimilarity that struck me time and again. I found the Chinese very practical and earthy. Indians, on the other hand, tend to be more spiritual and cerebral, if you like, grappling with abstract notions and ideas, e.g., calculating the distance from the earth to the sun and so on. This, of course, is a very general observation and does not imply that every Indian or Chinese fits into the mould.

Perhaps, China is like the left hemisphere of the brain and India, the right! Together, they are complete and effective. Today, China is becoming the factory of the world and India, its so-called 'back-office'. I believe, it's a matter of time before India becomes the ideas factory or the laboratory of the world.

China and India will then become the centre of the world and, in a manner of speaking, the middle countries!The world will then, again, need Asia and look to it, as it did some centuries ago!

Every culture of the world develops from the beliefs, practices and customs, traditions and values of its people. Through their lifestyle they develop systems of moral codes and norms, which they enrich with their activities and customs, of, which the arts, music, architecture, literature etc. have been a very majorly integral component. To understand a kind of people the most important thing to study is their literature, and art. In case of India, the cultures that have developed are not one but many. The subcontinent has been a rich base for the cultivation of an even richer set of cultures, which have been influenced by different settlers of over thousands of years. The multitude of languages spoken and the mix of religions present have further enriched the land and its people. This paper in particular focuses on the visual arts and architecture in relation to their influence on Indian music.

Indian art is highly symbolic. The much-developed ritual-religious symbolism presupposes the existence of a spiritual reality that, being in constant touch with phenomenal reality, may make its presence and influence felt and can also be approached through the symbols that belong to both spheres. The art and architecture produced on the Indian subcontinent dates back to the 3rd millennium BC. Therefore from that alone it can be determined as to how culturally influenced it must have been. To Western eyes, Indian art can appear strikingly ornate, exaggeratedly sensuous, and voluptuous. A strong sense of design is also characteristic of Indian art and can be observed in its modern as well as in its traditional forms.

Indian art is religious inasmuch as it is largely dedicated to the service of one of several great religions. It may be didactic or edificatory as is the relief sculpture of the two centuries before and after Christ; or, by representing the divinity in symbolic form (whether architectural or figural), its purpose may be to induce contemplation and thereby put the worshipper in communication with the divine. Not all Indian art, however, is purely religious, and some of it is only nominally so. There were periods when humanistic currents flowed strongly under the guise of edificatory or contemplative imagery, the art inspired by and delighting in the life of this world.

Although Indian art is religious, there is no such thing as a sectarian Hindu or Buddhist art, for style is a function of time and place and not of religion. Thus it is not strictly correct to speak of Hindu or Buddhist art, but, rather, of Indian art that happens to render Hindu or Buddhist themes. For example, an image of Vishnu and an image of Buddha of the same period are stylistically the same, religion having little to do with the mode of artistic expression. Nor should this be surprising in view of the fact that the artists belonged to nondenominational guilds, ready to lend their services to any patron, whether Hindu, Buddhist, or Jaina.

The religious nature of Indian art accounts to some extent for its essentially symbolic and abstract nature. It scrupulously avoids illusionistic effects, evoked by imitation of the physical and ephemeral world of the senses; instead, objects are made in imitation of ideal, divine prototypes, whose source is the inner world of the mind. This attitude may account for the relative absence of portraiture and for the fact that, even when it is attempted, the emphasis is on the ideal person behind the human lineaments rather than on the physical likeness.

To be properly understood, the art of India must be placed in the ideological, aesthetic, and religious framework of Indian civilization. This framework was formed as early as the 1st century BC and has shown a remarkable continuity through the ages. The Hindu-Buddhist-Jain view of the world is largely concerned with the resolution of the central paradox of all existence, which is that change and perfection, time and eternity, immanence and transcendence, operate dichotomously and integrally as parts of a single process. In such a situation creation cannot be separated from the creator, and time can be comprehended only as eternity. This conceptual view, when expressed in art, divides the universe of aesthetic experience into three distinct, although interrelated, elements?the senses, the emotions, and the spirit. These elements dictate the norms for architecture as an instrument of enclosing and transforming space and for sculpture in its volume, plasticity, modeling, composition, and aesthetic values. Instead of depicting the dichotomy between the flesh and the spirit, Indian art, through a deliberate sensuousness and voluptuousness, uses one with the other through a complex symbolism that, for example, attempts to transform the fleshiness of a feminine form into a perennial mystery of sex and creativity, wherein the momentary spouse stands revealed as the eternal mother.

The Indian artist deftly uses certain primeval motifs, such as the feminine figure, the tree, water, the lion, and the elephant. In a given composition, although the result is sometimes conceptually unsettling, the qualities of sensuous vitality, earthiness, muscular energy, and rhythmic movement remain unmistakable.

The form of the Hindu temple; the contours of the bodies of the Hindu gods and goddesses; and the light, shade, composition, and volume in Indian painting are all used to glorify the mystery that resolves the conflict between life and death, time and eternity.

The arts of India expressed in architecture, sculpture, painting, jewelers, pottery, metalwork, and textiles, were spread throughout the Far East with the diffusion of Buddhism and Hinduism and exercised a strong influence on the arts of China, Japan, Myanmar (formerly Burma), Thailand, Cambodia, and Java. These two religions with their various offshoots were dominant in India until Islam became powerful from the 13th to the 18th century. With Islam, which forbids the representation of the human figure in religious contexts, geometrical patterns became the most common form of decoration in art and architecture created under India?s Muslim rulers, especially the Mughals.

The earliest surviving Indian architecture consists of brick buildings. While early wooden structures have generally not survived, later stone buildings, built in a similar style, are known. The oldest traces of architecture in India are the vestiges of buildings of burnt brick found at Mohenjo-Daro and Harappa (now in Pakistan), dating from about 2500-1750 BC. The subsequent Vedic period, which precedes the beginning of historical styles, is represented by burial mounds at Lauriya Nandangarh, in Bih?r State, and rock-cut tombs in Malabar, Kerala State.

The establishment of historical styles began about 250 BC in the time of the Indian king Ashoka, who gave imperial patronage to Buddhism. Accordingly, the monuments of this time were built for Buddhist purposes. A characteristic Buddhist construction was the tope, or stupa, a hemispherical or bell-shaped masonry monument, typically surrounded by a railing, and with four entrances marked by gateways, and designed as a shrine or reliquary. Buddhism waned after the 5th century as Hinduism and Jainism became dominant. The Jain and Hindu styles overlapped and produced the elaborate allover patterns carved in bands that became the distinguishing feature of Indian architecture. The Jains often built on a gigantic scale, a marked feature of their architecture being pointed domes constructed of level courses of corbelled stones.

The Hindu style is closely related to the Jain style. It is divided into three general categories: northern, from AD 600 to the present; central, from 1000 to 1300; and southern, or Dravidian, from 1350 to 1750. In all three periods the style is marked by great ornateness and the use of pyramidal roofs. Spire-like domes terminate in delicate finials. Other features include the elaborate, grand-scale gopuras, or gates, and the choultries, or ceremonial halls. The next style that remained dominant was that of the Islamic era. Islamic architecture in India dates from the 13th century to the present. Brought to India by the first Muslim conquerors, Islamic architecture soon lost its original purity and borrowed such elements from Indian architecture as courtyards surrounded by colonnades, balconies supported by brackets, and above all, decoration. Islam, on the other hand, introduced to India the dome, the true arch, geometric motifs, mosaics, and minarets. Despite fundamental conceptual differences, Indian and Islamic architecture achieved a harmonious fusion, especially in certain regional styles.

Indo-Islamic style is usually divided into three phases: the Pashtun, the Provincial, and the Mughal. Examples of the earlier Pashtun style in stone are at Ahmadabad in Gujarat State, and in brick at Gaur-Pandua in West Bengal State. These structures are closely allied to Hindu models, but are simpler and lack sculptures of human figures. The dome, the arch, and the minaret are constant features of the style. The Provincial style reflected the continued rebellion of the provinces against the imperial style of Delhi. The best example of this phase is in Gujarat, where for almost two centuries until 1572, when Emperor Akbar finally conquered the region, the dynasties that succeeded one another erected many monuments in varying styles. The most notable structures in this phase are found in the capital, Ahmadabad. The Mughal phase of the Indo-Islamic style, from the 16th to the 18th century, developed to a high degree the use of such luxurious materials as marble. The culminating example of the style is the Taj Mahal in Agra. This domed mausoleum of white marble inlaid with gemstones was built (1632-1648) by the Mughal emperor Shah Jahan as a tomb for his beloved wife. It stands on a platform set off by four slender minarets and is reflected in a shallow pool.

Building in India since the 18th century has either carried on the indigenous historical forms or has been modelled after European models introduced by the British. Numerous examples of Western styles of the 18th, 19th, and 20th centuries may be seen in public buildings, factories, hotels, and houses. The most outstanding example of modern architecture in India is the city of Chand?garh, the joint capital of Haryana and Punjab; the city was designed by the Swiss-born French architect Le Corbusier in collaboration with Indian architects. The broad layout of the city was completed in the early 1960s. Notable architectural features include the vaulted structure, topped by a huge, concrete dome, and the use of concrete grille and bright pastel colours in the Palace of Justice; the arrangement of concrete cubes topped by a concrete dome that is the Governor?s Palace; and the use of projections, recesses, stair towers, and other contrasting elements to break the monotony of the long fa?ades of the secretariat building, which are 244 m (800 ft) long. Modern Indian architecture has incorporated Western styles, adapting them to local traditions and needs?as in the design of the railway station at Alwar, Rajasthan State.

The next most important aspect of Indian culture is Indian Music. It is an element that forms an integral part of their religion in addition to the culture. Dance in fact is an expression of that music and that too has religious importance in Hinduism. However one other important issue to consider is that the art and the architecture of the land were greatly influenced by religious beliefs and customs, as has been seen especially by the Buddhist and Islamic religions. The same is true for the music. That too was greatly influenced by religion. In fact the first forms of music were religious hymns and ballads called bhajans. They were songs sets to musical instruments such as the sitar and table and they were stories about religion and mythology.

Just as there is no such language as Indian, but instead many hundreds of languages, with over a dozen considered major, so there is no single entity as Indian music. The range of musical styles and traditions in the subcontinent of South Asia, which comprises modern India, Pakistan, Bangladesh, Nepal, and Sri Lanka, is in proportion to the vastness of the geographical area and the density of population. This is most obviously the case with folk and tribal music. Given that India is predominantly rural, it could be claimed that such categories of music are those of the majority. On the other hand, the rapid development of communications and wider access to the mass media have helped to create what is almost, despite the language differences, a pan-Indian popular music, recorded and disseminated electronically. This emanates from the Indian film industry, the largest in the world, of which the products tend to adhere to formulaic devices, including many songs and dances.

If one wants to judge the growth of any society, one must study its laws. Laws represent the needs, aspirations, norms, ethics, priority and maturity of the people. Ideally they should reflect the collective, intellectual and progressive will of the people. Since no society is inert, and social processes are constantly changing, a good legal system is one which ensures that laws acclimatize to the changing situations and ensure social good. For more than one decade, both developed and developing countries have engaged in ambitious economic reforms programs. Justice, law and human rights are fundamental prerequisites for economic and social development. Economic Growth cannot be separated from the corresponding improvement in Legal field. . In this context legal or judicial development could be seen as contributing to the overall growth of the country. Therefore the attempt to reinvent Indian legal system is a major contributor towards national development.
The main sources of law in India are the Constitution, statutes (legislation), customary law and case law. The statutes are enacted by Parliament, State legislatures and Union Territory legislatures. Because India is a land of diversity, local traditions and conventions that are not against statute or morality or otherwise undesirable are, to a limited extent, also recognized and taken into account by the courts while they administer justice in certain spheres. Also, people of different religions and traditions are governed by different sets of personal law with respect to matters relating to family affairs. A unique feature of the India Constitution is the judicial system. A single integrated system of courts administers both Union and State laws. The Supreme Court of India, seated in New Delhi, is the highest body in the entire judicial system. Each state or a group of states has a High Court under which there is a hierarchy of subordinate courts. The Chief Justice and the other judges of the Supreme Court are appointed by the President. The Supreme Court has original, appellate and advisory jurisdiction. Its original jurisdiction extends to the enforcement of fundamental rights given by the Constitution and to any dispute among States and the Government of India. The decisions of the Supreme Court are binding on all courts within the territory of India. While the judicial process is considered fair, there is a large backlog of cases which results in considerable delay before a case is decided. This is due to lack of full strength of Judges in the courts at all levels. This feature of our Legal System can be improved by appointing more Judges.
For any legal system to be effective, it requires intelligent feedback and criticism. In India, earlier people used to hesitate in voicing their views but now they are aware of their legal rights and therefore do not hesitate in expressing their views regarding the legal system. This is a healthy practice as it does not isolate the legal system from the people. Earlier for any person law was confined to court rooms and lawyers' offices. But now the situation has changed and people have realized that law affects our everyday lives and more importantly, we can and should turn to the legal system to enforce our rights. India is one of the biggest democracies and this is reflected from our Legal system. In our legal system even a common man can approach the highest court of the country i.e. the Supreme Court for redressal of his grievances whereas in USA, the Supreme Court is accessible to only a few people.
Even now our legal system is such that it is being used mainly by the rich and the powerful to obtain unlawful gains for themselves, but now this is also undergoing a sea change. The masses are now very much aware of their legal rights and hence are better equipped to fight for their legal rights. Now more and more people are using the legal system to fight injustice and making it an instrument of social justice and wellbeing for the masses. For example the recent Manu Sharma and Jessica Lal's case created a furore in the country and has forced the legislature to make necessary changes in the legal system and hence improve it further.
Earlier the Legal system was not as well equipped to handle issues arising out of possible disputes between the MNCs and those of domestic industries and therefore stress was laid on the need for a new legal system in India. To encourage trade and industry the Indian Legal system has to improve and it has to be thrown open to the international market. Though attempts have been made towards this direction it will still take some time for the Indian Legal system to reach a high level in the international arena. Reinventing the Indian legal system can provide an enabling environment for achieving economic growth
as well as global recognition. A well-functioning legal and judicial system will be effective in encouraging investment as it will provide security to an investor. It will also lead to the efficient use of resources and technology. But this can be achieved not only by improving the Legal system but also the enforcement agencies. No matter how good is a country's legislation, it will not stand up by itself.
It is reiterated that the economic growth of any country will greatly revolve around a tough, strong and effective judicial system. In order to achieve this, ways and methods have to be found to reform the legal and judicial systems which will help in development and evolution of the Indian economy. One way is to establish Specialized Courts for adjudicating commercial or economic disputes like they have in the UK and USA. This helps in stream-lining procedures which further reduces delays in the Legal system. Efforts should be made to solve disputes arising out of investment agreements, specially regarding foreign investors, through conciliation and arbitration. India has also upgraded its legal system to handle patent related litigation and to allow patent in all areas of technology.
There are still too many laws which have outlived their utility and need to be changed and reformed. There are still too many loopholes in the legal system which need to be plugged. The legal system needs to be transparent and autonomous so as to attract more investors. These changes are taking place in the Indian legal system but we still have a long way to go.
The hope of the Indian masses does not lie in the legal system alone - that is obvious - but in their conscious awakening and battle for social and economic justice. Awareness of their legal rights however, can be an important encouraging force in this. Of late, many agencies and individuals are rising in different parts of the country to take up the cause of social change... and change for a more just India, where justice will not merely be talked about in scholarly discussions on the niceties of law, or written about in books which the masses can't read but actually lived and experienced by the majority of the people.

Indian Jute Industry

The movement of industrialisation was initiated way back in 19th century by coal mining, engineering and the two textiles industries including cotton and jute. For some decades before seventies, the jute industry's contribution in the total foreign exchange revenue of our country remained the single highest, fluctuating between 25 and 33 per cent. According to history, the share of the jute industry to the national economy has been truly exceptional.

The destiny of the ancient jute industry has been variable and there have been various ups and downs. However, the separation of the country in 1947 resulted in a major political disturbance, unparalleled in any huge industry anywhere, when all of a sudden it was found that while the entire industry settled in India, most of the jute cultivating areas went to the then East Pakistan, which regrettably became an unfriendly neighbour at that moment. While the determination displayed by the jute industry and the farming fraternity was truly extraordinary and commendable, the sudden surfacing of several new jute mills in the then east Pakistan generated large extra capacities, but growth of new products like jute carpet backing combined with continuous increase in the food grains production in the country facilitated to solve the problem of imbalance in demand and supply. India reappeared as the largest raw jute manufacturer and maintained this status.

Growth in last 50 years

Undeterred by all adversities and countless problems, the raw jute manufacturing in India has continued to go up and so has its demand due to excessive production in the jute industry. There is a strong basic structure for the jute industry available in India. Soon after independence and resulting separation of the country, the upper class of the Indian jute industry in a truly visionary manner founded two top-notch institutions, namely the Institute of Jute Technology and IJMARI.

The Institute of Jute Technology was started by IJMA to develop human capitals in the form of jute technologists with focused expertise to utilize the potential of the jute fibre taking into account of its own features and strengths for manufacturing jute products. It was believed that Serampur College of Textile Technology did not give special attention to jute spinning and weaving and the Dundee Institute in Scotland was too far to impart expert learning and talent. As per their calculation, the Indian jute crop has the ability to reach the level of 17 millions bales as against the present level of 11.5 millions bales without much of a spread in the land area.

The survival spirit is shared by one and all.

Immensity of Jute Industry in India

There are four million jute farmers in our country. This figure mentions the time when the crop size was thinner. The current amount of the jute crop being much larger without any recent growth in the production per acre, this figure of four million farmers may, in truth, be significantly larger but at present we should think about four million jute farmers. The jute bags in India are accepted to be utilized at least six times and this is an exceptional quality to be kept in mind when we discuss jute packaging of the Indian local markets. Therefore, Jute packaging is distinctive if we begin to recognize that jute bags are put to recurring uses. Moreover, a jute bag is never discarded even after 6th or more uses in packaging goods. Finally, after repeated six to seven uses, it is either utilised as a raw material in the paper industry or is re-cycled in the jute industry itself. If we do not recognise this trait of jute packaging, we will understand precious little of the area under discussion.

There is a vast network all through the country for gathering the used gunny bags for sorting them out as per quality and conditions, mending when needed, qualitywise are bundling and re-supply of the same for several needs. Hence, thrown out or discarded jute bags are never to be found in the country where billions of jute bags are in continuous use and reuse and that means repetitive buying ad selling after each use. This fact has to be seized in our mind which will tell us that this is Rs 5,000 crore jute industry's turnover based economic activity in India is worth many times more. This will also inform us that there are minimum 2 million people are working to gather the used gunny bags against exchange of money and getting them re-supplied for the reuse cycle. Can Indianapolis afford an NFL franchise?

Although pushed back by the Pacers $175 million taxpayer-supported Conseco Field House deal, he said his turn would come. He has repeatedly said that his NFL franchise cannot survive on the revenues provided from the RCA Dome, and that a new stadium is needed sooner or later.

Its tough making big money on an NFL franchise in a market this size without taxpayers subsidizing much of the costs. Taxpayers coughed up $20 million in 1998 to enlarge the RCA Domes suites and enhance the value of its expensive box seats. This actually cut the domes capacity to 57,900 seats, making it the smallest stadium in the league. In 2003 the team ranked 27th out of 32 NFL teams in terms of revenue and 29th in value.

"We're significantly, significantly below the average (in revenue), and that disparity is growing, Irsay told Indianapolis television viewers. Yet the average determines what our expenses are with the salary cap. That's what makes things so difficult."

However, as the Cincinnati Bengals have proven, a new stadium does not ensure a better profit. Even with a new stadium, the Bengals were 24th in revenue in 2002, with only $4 million more in revenues than the Colts.

The Colts lease at the RCA Dome runs until 2013, but the team can break the deal after the 2006 season if its revenues arent greater than or equal to the median in the NFL in two out of the next three seasons. Indianapolis could require the Colts to stay by paying the difference between the teams revenues and the leagues median.

In 2002 the Colts fell short by about $13 million. Under this arrangement, Indianapolis taxpayers presently pay the Colts about $12 million per year in direct subsidies.

The long-term solution, Irsay proposes, is a new stadium with more expensive suites, club seats and ticket prices. He says the teams future in Indianapolis depends on the ability to market yourself and sell seats, particularly the expensive suites and club seats. Agreed.

The RCA Dome has 104 suites. The leagues top franchise, the Washington Redskins, offers 280. The difference in revenue between the Colts and Redskins luxury suites likely exceeds $15 million annually. Total team revenues were $137 million and $227 million, respectively, in 2002.

Certainly it behooves Irsay to shop his team to the city that gives him the best deal. During the past decade, 21 of the leagues 32 teams have received new or renovated stadiums. An average sweetheart deal is a $323-million stadium, paid 65 percent by taxpayers , that holds 69,200 spectators.

But here are the $66,000 questions for Mr. Irsay: Even with an average $323-million stadium funded two-thirds by taxpayers, can the Colts sell more suites at greater prices to bring team revenues above the NFL median? Likewise, can the central Indiana football market sustain more suites, box seats and higher prices to keep the Colts in town?

Ive been thinking of recommending that the Libertarian Party buy the naming rights to the next Indianapolis Colts stadium, but now Im having second thoughts.

At a recent sold-out home game, I was unable to sell the two extra $45-seats that I had at any price. There was no one besides ticket scalpers to give the tickets. I swallowed the $90 in losses, not to mention two grossly expensive $6 beers during the game. (Hey, I was thirsty and now have my third plastic commemorative Colts cup!)

Before a new stadium becomes economically realistic in Indianapolis, demand for Colts tickets, box seats and luxury suites must exceed their supply. This burden of truth falls on Jim Irsay, and he must meet this before taxpayers make more concessions.

Funding a new stadium with $400-plus million of taxpayer debt (excluding interest) is to gamble on the teams ability to sell itself to more fans and at a higher premium.

This will be a much harder task than giving away my extra tickets.

As per Indiainfoline "Outsourcing Summit at Gurgaon on 19th December 2005, the Confederation of Indian Industry (CII) led discussions on "Fuelling the Next Phase of Growth: Are we ready for it" with parallel sessions on off-shoring outsourcing in IT, BPO services and the automotive industry."

Chandigarh Real Estate: Call of the Siren

NEO-IT, a US based agency ranks Chandigarh amongst the top six destinations in India for investment in the IT sector, a city whose name also features amid the top six Indian States, who are leaders in e-Readiness and e-Governance. In an unexpected surprise movement, it is fast emerging as a favoured destination for top-ranked IT firms along with Bangalore, Hyderabad, and Gurgaon. The reason behind Chandigarh's attraction lies in not only in its high quality of life, but also due to the availability of requisite human resources to support and sustain a burgeoning industry.

A 250 km. optical fibre cable network, international bandwidth, single window facility for companies and quality manpower has proved to be the siren call for IT giant Infosys, an Indian stalwart inveigled into setting up a software development centre, the first phase of which has been completed with work begun on the second. According to Vivek Attray, IT Director, Chandigarh Administration: "The IT Park integrates an open and green area with modern infrastructure. It comprises of a ready built space, a 30-acre Infosys campus, sub-anchor and built-to-suit sites, entrepreneur development centre, dedicated power station, a huge retail space and earth station." And, Infosys has been followed by IBM, Wipro and others wishing to establish their presence in a city that has what it takes to meet the most exacting of business demands.

With the Chandigarh Administration planning a Technology Habitat, a 250-acre mini township is scheduled to come up adjacent to the Rajeev Gandhi Chandigarh Technology Park (RGCTP). "The Habitat will project the planned face of modern development, assisted by modern technology to serve the modern needs of the industry and those employed by the technology companies. It will also comprise residential complexes, institutional areas, commercial areas, sporting areas, and ample green belts." according to Vivek Attray.

Already, DLF, a Delhi-based real estate development firm has joined hands with the Chandigarh Administration in setting up ready-built office space at RGCTP offering 8-lakh sq. ft. of prime workspace to IT firms. And, in order to upgrade suitability and sustainability of human resources for the IT / IT-enabled services (ITeS) and Business Process Outsourcing (BPO), Chandigarh Administration has set up a soft skills training programme in the city. With a population of 1-million and a literacy rate of 82%, Chandigarh offers a huge talent pool for IT / ITeS / BPO companies that invest here.

According to Chandigarh Administration, 42-Indian and foreign firms e.g. Amadeus, Century Technologies - California, KMG Infotech, UK's Index Computer Systems, Virsa Systems among others have applied for the six built-to-suit sites covering 10-acres. Ever since RGCTP was declared a Special Economic Zone (SEZ), Chandigarh's tech park has attracted a lot interest with companies from USA, Great Britain, Finland and across the globe applying for the six built-to-suit sites.

Expecting a huge deluge of IT professionals and those wishing to work in the BPO sector, prices of residential property near the park have sky-rocketed. With an expected 25,000 jobs generated by a fully functional IT Park, the housing sector could face a immense pressure, a fact that has created boom like conditions for real estate in Chandigarh and its surrounding areas. Even Mansa Devi, a small, sleepy little rural colony in the vicinity of the IT Park has experienced a rise in real estate prices. Three bedroomed flats that a few years back could be bought for Rs. 15 to 16-lakhs in Sectors 4 and 5 of Mansa Devi are now going for Rs. 30 to 35-lakhs, as property dealers pin their hopes on and wait for the IT Park to fulfil their dreams of an unexpected bonanza. It is not only property prices that have been affected but rents have doubled and tripled with the opening of the park in September 2005, and residential plot prices have jumped from Rs. 350 - 400/- to Rs. 700 - 750/-, all due to the opening of park.

In a domino effect, the cost of real estate in and around Chandigarh, from Mohali, Panchkula, and surrounding areas is getting more expensive by the day, with multi-nationals and Indian IT / BPO giants coming to stake a claim in the city. As the UT administration works on making Chandigarh a tourist destination, it is only a matter of time before it joins the big league of Tier I cities in attracting foreign direct investment (FDI) on a large scale.

A chain of events has been set in motion with the opening up of Chandigarh's IT Park, and the Punjab Government's desire to progress beyond the Green Revolution will ensure that Chandigarh remains the prime destination of choice for FDI. With everything going according to plan, real estate in Chandigarh remains the best form of investment, both for the short and the long-term, premium real estate, unmatched by any other Indian city. And, the Punjabi Diaspora, no longer happy to live in the villages and rural towns they left behind are setting the real estate prices in the city aflame by going on a real estate shopping binge with their hard-earned dollars.

The curve of Chandigarh's real estate prices is on an upward trajectory, never to be the same again!

The teaching of VM/AIM is done following the usual techniques like lecturing, using Audio-visual equipments like OHP, slide projector, computer aided learning, etc.

(ii) Using complimentary notation known as ?Vinculum? following examples will make clear, about the usage and benefits of this:

Indiana Jones and the Volcano

Experiencing a live volcano was on top of our agenda when my friend Rob and I visited the exotic land of Costa Rica. The plane touched down in the capital city of San Jose, and we headed for the car rental to pick up a 4x4 and a map to Mt. Arenal, the nearest active volcano.

After an arduous drive through torrential rain, we finally arrived in a quiet village supposedly at the foot of a fire-belching monster. I say supposedly because it was so foggy, we werent even sure a volcano existed. We couldnt see a tree a block away, let alone a volcanic mountain looming 5,000 feet above us.

Locals claim if you really listen closely, you can hear the beast rumble. We never heard a whimper. By the second misty day and night of no sighting, I suspected the local population had fabricated the story of an erupting volcano in order to attract tourist dollars. A volcano of convenience. No muss, no fuss. Just some imaginary rumbling every so often that only the locals hear from a volcano no one ever sees because of the rain and fog!

Waiting out the rain, we were eating a tasty native dinner of red beans and rice at a colorful local dive when the owner of the caf strolled over to our table. Without invitation, he plopped himself down. Miguel appeared to me exactly as Ive always imagined don Juan of Carlos Castaneda fame to look. His face was dark and swarthy with a kind but inscrutable expression. Staring straight into our eyes, he declared in halting English, You want to know volcano, not just look at it.

Being a veteran traveler, I have learned to be agreeable in a foreign country and, in general, say yes to practically everything spoken to me by the locals. Not realizing the full import of the distinction between the words Miguel had used, I responded amicably, Yeah, yeah, of course, wed like to know the volcano.

Without another word, Miguel turned over my paper place mat and began to draw a crooked line. We watched in silence as he guided the pencil over the grease-stained paper in absorbed concentration. What emerged was a detailed map of twists and turns with landmarks indicated by little, kid-like pictures of trees, stone walls and tiny shacks to represent a village.

Finished, Miguel sighed and spoke directly into our souls with piercing, green eyes. This map take you to volcano. To be with volcanoto feel and know spirit of volcano. The sound of the cold, drenching rain woke us at dawn. We still couldnt see or hear the volcano. Since the downpour discouraged us from any tourist activity, we decided we may as well get soaking wet following Miguels map to wherever it led.

We drove up the steep mountainside until the rugged jeep road ended abruptly at a craggy cliff. I was very surprised Miguels hand-drawn map actually corresponded to what we found on our journey. We followed our friends makeshift chart through a hole in a fence, up a circuitous rocky path, over many collapsed lava rock walls and past long-deserted fruit orchards. The trail ended at an imposing 300-foot wall of solid volcanic lava flow so jagged and sharp we couldnt climb it.

Fortunately for us, Miguel had anticipated this challenge. At the edge of the lava flow, his map showed a naturally camouflaged trail through the dense rainforest. We plunged into the dark primeval forest. The jungle growth was so thick with vines and roots, the path so muddy and slippery, I felt wed dropped into a comic scene right out of the Harrison Ford movie Indiana Jones and the Raiders of the Lost Ark. During one hilarious moment, Rob and I both lost our footing and, clutching each other, slid back down fifty feet of the mudslide trail. Grabbing overhanging vines, Tarzan-style, saved the dayand our necks! Our guardian angels must get a lot of overtime pay!

Undaunted and filled with the rush of adventure, Rob and I helped each other stand up, pull ourselves together and restart the climb. Clawing and scratching our way through the rainforest, we finally reached the top of the lava flow. My first impression was how very windy and cold it was up there for a tropical climate. The pouring rain and dense fog had persisted, obliterating the view of anything more than a foot in front of us. As we inched our way along the top of the volcanic rock, I remembered how Miguel had told us of his many idyllic picnics here with his friends. Not very conducive weather for a picnic on this morning!

Suddenly, a booming roar filled the air, followed by a very powerful rumble that reverberated throughout our bodies. We felt the Earth roll in one undulating wave after another! Even though Rob and I had never experienced an eruption before, we instinctively knew this was the volcano showing its might. The ground continued to heave in unnerving spasms. People-size boulders sped past us down the slope. Flying rocks were propelled into nearby trees, the sheer force imbedding the projectiles cleanly into their trunks. We heard and felt nearby avalanches crashing their way down the mountain. We could only see a fraction of the devastation because of the blinding downpour, but our bodies definitely registered the massive rearrangement all around us.

A sharp electric terror shot through every cell of my body. Its message was explicit and commanding, Leave! Now! You must go now to save your life.

I shouted to Rob, Were out of here! Its not safe! To my astonishment, he shook his head from side to side indicating he didnt want to go.

Im staying. This is too cool! he yelled over the roar of the wind and falling rock. He was nineteen years old. His sense of novelty and exploration was still stronger than his sense of danger and good judgment. I started to argue. I made zero impression on the brash, young daredevil.

Then another explosion rocked our world. I watched in horror as the heat, ash and force of the blast denuded a huge 200-foot tree in one second, stripping off all its leaves and limbs. If this volcano could do that to a tree, it could do the same to us! I knew with certainty I was supposed to leave posthaste.

Jumping off the top of the lava mound right into the rainforest, I bolted without another thought. I threw myself into the Raiders of the Lost Ark express mudslide, riding the flowing water and sludge through the dense jungle growth down the side of the still-quaking mountainside. In what seemed like only a few seconds, I arrived at the bottom of the lava flow. The path was certainly faster and easier going down than climbing up! For a brief moment, I lay soaked to the bone, resting in a mud puddle, my ripped clothes covered with brown muck.

Recovering some of my composure, I became aware for the first time of heat radiating from the lava flow smoldering several feet to my left. I crawled in the direction of the flow until I was within a few inches of the mass. To my surprise, the air felt like I had just opened a 400-degree oven. The surface was so hot, I instinctively jumped back a few feet. When we first arrived earlier in the morning, the extremely cold wind and pelting rain had so neutralized the radiant heat from the lava, we didnt even notice the temperature.

But the heat was not the only aspect of the lava that the elements had concealed from us. I picked up a small twig and approached the foot of the black mound that had gushed from the top of the mountain. Getting as close as I could to the sulphurous heat, I stuck the branch into the rain-drenched ground about two inches in front of the lava. Within a minute, the lava hill reached the stick and buried it!

Suddenly my whole body reeled with the involuntary shudder of recognition. For the last hour Rob and I had been walking on a live, moving lava flow! And Rob was still up there running around on the molten granite.

Another eruption, three times louder than the first one, filled the air. My ears throbbed from the deafening boom. My feet and body registered avalanche after avalanche of crashing rock careening down the side of the volcano. Descending the rough trail, I ran head over heels in a panic, determined to outrun any rockslides coming my way. After a half-hour of the fastest, long distance race Ive ever run, I arrived at our jeep safely sheltered under a broad-armed tree. Collapsing into the front seat, I fought to catch my breath.

As my pulse and mind quieted, I was overcome with fear for the safety of my friend still walking around on the moving bed of liquid rock in the midst of periodic violent explosions. I began feeling intensely responsible. Id left a young kid in my charge on top of an erupting volcano! A nightmarish vision bombarded me. I saw his parents, who had entrusted their son with me, watching local authorities dig through the rubble of the volcano searching for the body of the lost American youth. Feeling so guilty and worried I could neither relax nor rest, I decided I must leave the jeep and hike back up the volcano. I had to find Rob.

No sooner had I opened the door of the jeep than an insistent inner impulse told me to stay put and listen inside for further instructions. When I receive such forceful commands from my inner coach, I usually obey. Quieting myself as much as possible under the circumstances, I endeavored to get in touch with my next best intuitive move. I challenged myself, Was it wrong what I did? Was it selfish and self-absorbed to look after my own safety and leave a young kid behind?

After I felt all the intense emotions stirred up from asking these soul-searching questions, I received a very strong message directly from Spirit. My inner knowing spoke to me emphatically, saying:

You did the right thing. You followed your intuition. If you recall specifically, your inner coach told you that it was dangerous for you to stay, and that you needed to leave immediately. It said nothing about your friend Rob. Nothing at all. You were right to follow your guidance and leave. In fact, had you stayed, you may very well have endangered your friends safety! Had you stayed, you would have been out of alignment with your intuition and, therefore, out of harmony and integrity with yourself. This discordant state has a strong tendency to interfere with another persons ability to tap into and follow his or her own knowing. Had you stayed, you may have hindered Robs ability to hear and heed his inner direction. You took the most helpful, loving and appropriate action by following the letter and spirit of your intuition. You following you own internal urging allowed your friend the space to realize he must rely on his own internal wisdom.

Spirits message was a fascinating new lesson in intuitive guidance for me. In general, and for its reassurance in my present predicament, I was grateful for this fresh perspective. I never before realized the precision of intuition. I never before understood the independence of one persons guidance from the inner counsel of another person in a shared situation.

At the exact moment I realized the import of what I was being told by my inner coach, Rob came streaking down the trail toward the jeep. In the fury of the last violent eruption, Rob received his own internal signal to vamoose. Guided by his own inner compass, he immediately took the Mudslide Express through the jungle to safety. I was extremely relievedand appreciative to Spiritthat my nightmare vision of Robs demise was averted. I gave silent thanks for the eternal lessons I learned from our escapade.

Back on solid ground, Rob and I were anxious to leave the mountain rains and clouds. We hopped into the jeep and sped toward the sunny western coast of Costa Rica. Driving down the mountainside, we both lapsed in and out of thankful silence for being alive. Perhaps the next day, the mornings events would seem a great adventure, but, right then, the very real danger wed just survived remained very palpable and raw. Our minds, emotions and physical bodies were still remembering and replaying our narrow escape.

Suddenly, Rob and I experienced simultaneous intuitive hits to pull over and get out of the jeep. Leaning against the vehicle, we turned as one toward the top of the mountain wed just descended. As if waiting for us to stop our downward trek away from the mountain and turn our gaze upward, the clouds parted to reveal the awesome Mt. Arenal volcano for the very first time since our arrival in Costa Rica so many days earlier. The dense mist lifted. We saw exactly where we had been hiking on the lava flow. We pinpointed where the tree line ended and the lava flow began. Wed been standing only a hundred yards from the open mouth of the volcano when it erupted!

The restaurant owner Miguel had promised we would be with, we would feel and we would know the spirit of the volcano. He said the mountain would definitely erupt when we were there. And hed promised the volcano would not harm us. The rain and his crude map tricked us into going so close to the volcano that we did, indeed, get to know the volcano, not just view it.

Was it the spirit of the volcano that sent Miguel to us? and turned the skies into a torrential downpour in order to obscure the treacherous nature of our journey so we wouldnt be scared off? Rob and I agreed, stranger things have happened. One thing was certain. If wed been able to see where we were going, we would never have walked as close as we did to the mouth of the cauldron.

Now, viewing the majesty of Mt. Arenal, we were humbled and ever so grateful for the experience of having been able to safely feel the mountains power and personality. As we were sending out our thankfulness to and admiration of the volcano, the mountain erupted again with an explosion twice as high as the volcano itself. Two miles of elegant ash plume shot up into the dark blue sky. The event was quite dramatic and very humbling.

We knew the volcano was responding to our love and appreciation for its gift to us that day. Then the clouds closed back in and our mighty friend said good-bye, leaving us forever changed and enriched by its friendship.

Adventure Through Sullivan Cave Indiana 1973

It was convention time in Indiana and this would be my first NSS (National Speleological Society), convention. John Wallace, Jack Pace and I flew to Indiana in John's small plane. Landing a small plane at a commercial airport was quite exciting, they directed us to the runway from the side as large jets were landing and at the last moment had us make a sharp 90 degree turn and land as quickly as possible. Then taxi at top speed to the nearest taxi way to get off the runway before another jet landed.

The 1973 convention was being held at Indiana University in Bloomington and was a huge success, capped off by our banquet speaker Roger Brucker relating the exciting story of the discovery of the Flint-Mammoth cave connection, making it the world's largest cave system. I was also excited over winning third place in the prusik contest. I climbed 100 feet of nylon rope, in one minute and forty-two seconds in the 30-39 age group. I believe that there may have been only three contestants in this age group!

One of the caves open to the convention attendees was Sullivan Cave. The three of us decided to have a look at the cave. We entered the cave through the small narrow passage for a short distance before connecting with the Backbreaker passage. This was a long passage with a ceiling height of about 3 to 4 foot. This finely intersected the main trunk passage at the "T." Following the trunk passage to the left to the Mountain Room passage, then a short distance to the Mountain Room. We spent some time exploring the Mountain Room and as we about to leave some very wet cavers appeared. After talking with them they shared that they had entered the cave through the Speed Hollow Entrance.

This was a very tempting choice, to leave by another entrance and avoid that long trip back through the Backbreaker passage. They left a good easy to follow trail as it was wet from their passing through. We traveled about half the distance that we had come thus far and reached a room called the Spiral Room. Crossing over a flowstone floor through a short crawl, we found the Manhole.

Looking down the Manhole, all we could see was water. We turned off our lights and let our eyes adjust to the darkness and then leaned down into the Manhole as far as possible. There was a very slight glow of light shining from the far side of the underground lake. John dropped in first and could not touch the bottom. After struggling for a while he finely found a spot where he could touch the bottom. We all followed behind dropping into the cold water and headed for the light as fast as possible.

As we sloshed through the water the waves reached the ceiling getting us completely soaked, ears, eyes and all. There was no turning back now, we just gulped air between waves and continued. Near the exit the passage became lower until we were crawling in the water with only a few inches of air space. When we climbed out of the water and into the daylight it sure felt good.

Now we had another problem. We did not know where we were. There was no road in sight only an open field and the wooded hills. We did not even know wich direction we had gone in the cave. After exploring the field we found the main road and took a guess at the direction to walk. It was quite an adventure but I believe we try and do a little better planning next time.

Hilsa is the national fish of Bangladesh. Hilsa is an integral part of the Bengali culture. One cannot imagine the monsoon in Bengal without cooking and feeding on fried Hilsa, or Ilish, as it is known in Bengali. It is also associated with religious ceremonies, and purchasing hilsas on soma occasions like on the day of Saraswati Puja is even considered auspicious.

Essentially a sea fish, hilsa caught from the sea are thin and small, and not at all tasty. In the rainy season, the fish swim into the inland rivers to lay eggs, and become fleshy and extremely tasty. Sweet water Hilsa, especially from the river Padma that runs through Bangladesh are believed to be the best in taste.
There are various ways to cook the hilsa. It can be smoked, fried, steamed, baked. Often it is wrapped in young plantain leaves and baked in a steaming pot of rice. It can also be prepared with curd, brinjal or green banana.

Here is a recipe to prepare Hilsa with mustard seeds.

Ingredients needed

Hilsa fish: 500 gm (can be substituted with Salmon, tastes almost the same)

Mustard seed: 5 to 6 teaspoon full

Paste of Green chillies: 6 or 7

Turmeric: half teaspoon full

Oil: 6 to 7 teaspoons

Salt to taste

Procedure

Wash the fish properly. Make a paste of the mustard seeds and mix well with the turmeric and green chilli paste. Coat the fish with this mixture along with the salt and the oil. Marinate for about an hour. Then bake in a microwave for 12 minutes, till tender. Serve hot with cooked rice.
